Did you know that paternity leave in Brazil is about to change? In April 2026, a new law was published bringing important rules regarding paternity leave and paternity pay. Currently, the leave period is only 5 days.
The main change is a gradual increase in the leave period:
- 10 days starting in 2027.
- 15 days in 2028.
- 20 days in 2029.
Special Cases and Worker Rights For children with disabilities, the leave period will be increased by one third. Additionally, if the mother or baby is hospitalized, the leave may be extended, and in some situations, the father may have rights equivalent to maternity leave.
To be eligible, the employee must present a birth certificate or adoption document, notify the employer in advance, and refrain from any paid activity during the leave. During this period, the job is protected—dismissal without just cause is not allowed—and paternity pay is guaranteed.
